Terms of Use

These Terms of Use (“Terms”) constitute a legally binding agreement between you and Vaksera governing access to and use of the Vaksera platform at https://vaksera.com (the “Platform”).
Please read these Terms carefully. By creating an account, browsing, or using any feature, you agree to be bound by these Terms and our Privacy Policy and Disclaimer. If you do not agree, you must not use the Platform.
1. Definitions
- User — any person who accesses the Platform.
- Advocate user — a User who registers as an advocate and may be subject to approval.
- Content — text, images, listings, drafts, reviews, and other materials submitted or generated on the Platform.
- Services — all features offered by Vaksera, including templates, acts, search, diary, payments, and related tools.
2. Eligibility
You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872. Advocate users represent that they hold a valid enrolment with a State Bar Council (or are otherwise authorised to practise as permitted by law) and that all professional details submitted are true and current.
You may not use the Platform if you have been suspended or banned, or if use is prohibited by applicable law.
3. Account registration and security
- You must provide accurate registration information and keep it updated.
- You are responsible for all activity under your credentials; do not share passwords or OTPs.
- We may require email/mobile verification, advocate approval, or additional KYC before enabling certain features.
- We may refuse registration, suspend, or terminate accounts at our discretion for breach of these Terms, fraud, or risk to the Platform.
4. Description of services
Vaksera currently or may in the future offer:
- Court petition and application templates with online fill, preview, and Word export.
- Bare-act and section reference pages with educational summaries.
- Advocate directory, court availability listings, and lead-contact unlock (paid where applicable).
- Case diary and profile management tools.
- Articles, FAQs, and SEO content related to legal drafting.
Services may change, be beta-tested, or discontinued without prior notice. We do not guarantee uninterrupted or error-free operation.
5. Not legal advice; no advocate–client relationship
Vaksera is not a law firm. Nothing on the Platform constitutes legal advice, opinion on merits, or solicitation. Use of templates, act text, or articles does not create an advocate–client relationship between you and Vaksera.
Any professional arrangement between users arising from the Platform is solely between those users. See the Disclaimer for further limitations.
6. Your responsibilities
You agree to:
- Independently verify statutes, rules, court fees, limitation, jurisdiction, and facts before filing any document.
- Adapt every template to your court, cause title, annexures, and local practice directions.
- Comply with Bar Council of India rules, court rules, and all applicable laws.
- Not upload unlawful, defamatory, harassing, or infringing content.
- Not scrape, reverse engineer, overload, or circumvent access controls on the Platform.
- Not impersonate another person or misrepresent professional status.
- Not use the Platform for spam, pyramid schemes, or unauthorised commercial solicitation.
7. User content and licence
You retain ownership of Content you submit. You grant Vaksera a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute such Content solely to operate and promote the Platform (including showing your profile to searchers).
You represent that you have all rights necessary to submit Content and that it does not violate third-party rights or law. We may remove Content without notice where required by law or these Terms.
8. Intellectual property
The Platform software, design, logos, and original compilations are owned by Vaksera or licensors. Statute text may be subject to government copyright or public domain rules as indicated on act pages. Template structures and platform UI may not be copied for competing services without permission.
You may download and use generated Word drafts for legitimate professional or personal legal purposes, subject to court filing rules.
9. Payments, lead credits, and refunds
Certain features (e.g. lead credits) require payment through our payment partner. Prices and packages are displayed at checkout. You authorise us and our partner to charge the selected amount.
- Lead credits are consumed when used; balances may expire as stated at purchase.
- Refunds are generally not provided except where required by law or explicitly promised in writing.
- Payment disputes should be raised promptly via Contact with transaction ID.
10. Third-party services
The Platform integrates third-party services (hosting, email, payments). Your use of those services may be subject to separate terms. We are not liable for third-party failures beyond our reasonable control.
11. Disclaimer of warranties
THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT TEMPLATES OR ACT TEXT ARE CURRENT, COMPLETE, OR SUITABLE FOR ANY PARTICULAR CASE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Vaksera AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR CASE OUTCOMES, ARISING FROM YOUR USE OF THE PLATFORM.
OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) INR 5,000, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
13. Indemnity
You agree to defend, indemnify, and hold harmless Vaksera from claims, damages, losses, and expenses (including reasonable legal fees) arising from your Content, your use of the Platform, violation of these Terms, or violation of any law or third-party rights.
14. Termination
You may stop using the Platform at any time. We may suspend or terminate access immediately for breach, risk, or legal requirement. Provisions that by nature should survive (IP, disclaimers, liability limits, indemnity, governing law) will survive termination.
15. Governing law and disputes
These Terms are governed by the laws of India. Subject to applicable consumer protection laws, courts in India shall have exclusive jurisdiction. We encourage you to contact us first to resolve disputes informally.
16. Force majeure
We are not liable for failure or delay due to events beyond reasonable control, including natural disasters, war, internet outages, government action, or failures of third-party infrastructure.
17. Severability and entire agreement
If any provision is held invalid, the remainder remains in effect. These Terms, the Privacy Policy, and Disclaimer constitute the entire agreement regarding the Platform and supersede prior understandings on the same subject.
18. Changes to terms
We may modify these Terms at any time. Updated Terms will be posted with a revised date. Material changes may be notified by email or Platform notice. Continued use after the effective date constitutes acceptance.
